Terms of Service

1. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service in a way that violates any applicable laws or regulations.
• Interfere with or disrupt the Service or the servers and networks connected to it.
• Attempt to gain unauthorized access to any part of the Service or other user data.
• Send spam or unwanted invites, or use automated means to access the Service.

The Service is intended for personal, non-commercial use only. You must be at least 13 years old, or the minimum age required in your country, to use the Service.

2. Accounts

You can use Sync Player without an account, as a guest. Creating an account is optional: you can sign in with Apple or Google, mainly to use Premium on all your devices.

You are responsible for keeping your Apple or Google account secure and for all activity that occurs under your Sync Player account.

You can delete your account at any time in the app under Settings → Account → Manage account → Delete account, or by contacting us. Account data that has not been used for 180 days is deleted automatically. Our Privacy Policy explains what deletion removes.

Deleting your account does not cancel a store subscription. See Section 7.

3. Rooms, Chat and Voice

Sync Player lets you watch videos together with others in private rooms, which people join with a room code or invite, and in public rooms, which anyone using the app can find and join.

When you take part in a room, other people in the room can see your nickname, avatar and chat messages, and can hear you if you use voice chat. Public room listings show the room name, the host's nickname and what is playing.

When using rooms, chat, voice chat, invites, nicknames or avatar photos, you agree not to:

• Harass, threaten, bully or impersonate others.
• Post hateful, sexually explicit, violent or otherwise offensive content.
• Share other people's personal information without their permission.

You can report messages and public rooms, and block other users, in the app. A room's host can remove viewers from the room. We may review reports and remove content, or restrict or suspend users who break these Terms, temporarily or permanently.

4. Google Drive Access and Permissions

Sync Player integrates with Google Drive to provide features such as:

• Selecting and playing your video files.
• Watching your files together with others in a room.

When you play a Google Drive file in a room with others, the app may update that file's sharing setting to "Anyone with the link can view" so that the others can access and watch it.

This applies only to files you choose, and is explained in the app interface.

You remain the owner of all files stored in your Google Drive.

You can change or revoke sharing permissions at any time from Google Drive.

5. Third-Party Services and Content

Sync Player can play videos from third-party services such as YouTube, Netflix, Disney+, Prime Video, VK Video, Google Drive and Dropbox. We are not affiliated with or endorsed by these services.

To watch content from a service, each viewer needs their own access to it, including their own subscription where that service requires one. Your use of each service is subject to its own terms, and we are not responsible for its content, availability or changes to it. Some content may be unavailable in the app or in your region.

6. User Content and Responsibility

You are solely responsible for the files, videos, links, subtitles, messages and any other content you share or stream through the Service.

You agree not to use Sync Player to:

• Upload, share, or stream content that infringes intellectual property rights, violates privacy, or breaches any laws.
• Distribute or promote harmful, illegal, or inappropriate material.

We are not responsible for content shared by users through the Service, Google Drive, Dropbox or other services.

7. Premium, Subscriptions and Ads

Sync Player is free to use with ads. Premium is an optional paid upgrade that removes ads for you and for friends who join your rooms, and adds features such as HD voice chat and unlimited Picture-in-Picture. The features included may change over time.

Premium is offered as monthly or yearly subscriptions, and where available as a one-time lifetime purchase. You can also gift Premium to others (see Gifting Premium below). Prices are shown in the app before you buy.

• Payment is charged to your App Store or Google Play account when you confirm the purchase.
• Subscriptions renew automatically at the end of each period unless cancelled at least 24 hours before the period ends.
• You can manage or cancel your subscription in your App Store or Google Play account settings. Deleting the app or your Sync Player account does not cancel it.
• Refunds are handled by Apple or Google under their policies.

Purchases made as a guest belong to the device they were made on. To use Premium on other devices, sign in to an account. You can restore purchases in the app, which moves them to the account (or guest) currently signed in on that device.

Gifting Premium

In a private room, you can gift 1 month or 1 year of Premium to another person in the room. A gift is a one-time purchase charged to your App Store or Google Play account, and it doesn't renew.

• You can't send a gift to someone who already has Premium, who already has a gift waiting, or who has blocked you.
• A gift waits until the recipient opens it. To open it, the recipient must sign in to an account, and the Premium is added to that account.
• If the recipient already has Premium when they open the gift, the gifted time starts when their current Premium ends.
• A gift that isn't opened within 180 days of purchase expires. A gift is also cancelled if the recipient deletes their account before opening it.
• Refunds for gifts are handled by Apple or Google under their policies. If a gift is refunded, the Premium it gave is removed.

8. Intellectual Property

All intellectual property rights in the Service, including but not limited to the app name, logo, software, and design, are owned by EverSync Pty Ltd or its licensors. Third-party components are listed under Settings → Open source licenses in the app.

You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we make no warranties, express or implied, regarding the operation or availability of the Service, or that it will be error-free or secure.

You use the Service at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, EverSync Pty Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

Our total liability to you for any claim shall not exceed the amount you paid (if any) for using the Service in the 12 months before the claim.

Nothing in these Terms excludes or limits any rights you have under the Australian Consumer Law or other consumer protection laws that cannot be excluded or limited.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service itself.

You may stop using the Service and delete your account at any time.

13. App Store Terms

If you downloaded Sync Player from Apple's App Store or Google Play, you also agree to that store's terms. These Terms are between you and EverSync Pty Ltd, not Apple or Google. Apple and Google are not responsible for the Service or its content, and have no obligation to provide maintenance or support for it.

14. Changes to These Terms

We may update these Terms from time to time.

Any changes will be posted on this page with an updated "Last updated" date.

By continuing to use the Service after any changes, you agree to the revised Terms.
